1. About this page
Bren’s Table respects intellectual property and follows the notice-and-takedown process of the US Digital Millennium Copyright Act (DMCA). We accept and review notices from rights holders anywhere, including the United Kingdom, the European Union and EEA, and Canada. This page expands on section 10 of our Terms of Service; our Content Policy asks players not to enter material they don’t have the right to use.
Most of what you see in the game is written or painted by AI in response to a player, and is shown only to that player. It can still sometimes resemble an existing work, and players can type in material they don’t own. Either way, if you believe it infringes your rights, please tell us.
2. Our designated agent
Send copyright notices and counter-notices to our designated agent:
- Name: Copyright Agent, Bren’s Table (the operator, a sole trader in the United Kingdom)
- Email: brenstable@gmail.com (please put “Copyright notice” in the subject line)
- Postal address: being set up, listed here soon
This address is only for copyright and other intellectual property notices. For anything else, see our Safety page.
3. Sending a takedown notice
To be valid under the DMCA, your notice must be in writing and include:
- your physical or electronic signature, as the copyright owner or someone authorised to act for them;
- a description of the copyrighted work you say is infringed (or, if several works are covered by one notice, a representative list of them);
- a description of the material you say is infringing and enough information for us to find it, such as the page, the character or campaign name, or a screenshot;
- your name, postal address, telephone number and email address;
- a statement that you have a good faith belief that the use of the material is not authorised by the copyright owner, its agent, or the law;
- a statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorised to act on their behalf.
If you are outside the United States, please include the same information. We’ll review it under the law that applies to you. If your notice is missing something important, we’ll ask you for it.
4. What happens next
- We’ll confirm we’ve received your notice and review it promptly.
- If it is valid, we’ll remove or disable access to the material and let the player whose account it came from know, including a copy of your notice, so they can respond if they believe it was a mistake.
- If we decide not to act, or need more information, we’ll tell you why.
5. Sending a counter-notice
If material you entered was removed because of a copyright notice and you believe that was a mistake or a misidentification, you can send a counter-notice to our designated agent. It must include:
- your physical or electronic signature;
- a description of the material that was removed and where it appeared before it was removed;
- a statement, under penalty of perjury, that you have a good faith belief the material was removed or disabled as a result of a mistake or misidentification;
- your name, postal address, telephone number and email address;
- a statement that you consent to the jurisdiction of the US Federal District Court for the judicial district where your address is located (or, if you are outside the United States, any judicial district in which we may be found), and that you will accept service of process from the person who sent the original notice or their agent.
When we receive a valid counter-notice, we’ll send a copy to the person who sent the original notice. Unless they tell us within 10 business days that they have filed a court action to stop the infringement, we’ll restore the material within 10 to 14 business days of receiving your counter-notice, where we’re able to.
6. Repeat infringers
We close, in appropriate circumstances, the accounts of players who repeatedly infringe other people’s copyright.
7. False notices
Please be sure before you send a notice or counter-notice. Under the DMCA (17 U.S.C. § 512(f)), anyone who knowingly misrepresents that material is infringing, or that it was removed by mistake, can be liable for damages, including costs and legal fees. If you’re unsure whether something infringes your rights, you may wish to speak to a lawyer first.
8. Trademarks and other rights
If you believe something on Bren’s Table infringes your trademark or another right, email brenstable@gmail.com with your details, the right involved and where the material appears, and we’ll review it in the same way.
